First Conviction DUI

If you were convicted of a first offense DUI in Kentucky within a five year period, your license will be suspended for a minimum of 30 days.

In order to regain your driving privileges:

  • Pay a $200 – $500 fine
  • Serve up to 30 day jail sentence*
  • Complete 20 hours maximum of alcohol or substance abuse program
  • Serve a 30 to 120 day license suspension

*If aggravating circumstances were present - four days imprisonment minimum

Second Conviction DUI

If you were convicted of a second offense DUI in Kentucky within a five year period, your license will be suspended for 12-18 months. In order to regain your driving privileges you will be required to install an ignition interlock device.

In order to regain your driving privileges:

  • Pay a $350 – 500 fine
  • Serve a 7 day to 6 month jail sentence*
  • Complete 52 hours to 26 weeks maximum of alcohol or substance abuse treatment
  • Serve a 12 to 18 month license suspension
  • You will be required to install an ignition interlock device for the length determined by court

*If aggravating circumstances were present - 14 days imprisonment.

Third & Subsequent Conviction DUI

If you were convicted of a third DUI offense within five year period, your license will be suspended for a minimum of two years. In order to regain your driving privileges you will be required to install an ignition interlock device.

In order to regain your driving privileges:

  • Pay a $500 – 1,000 fine
  • Serve a 30 day to 365 day jail sentence*
  • Complete 52 hours to 52 week maximum of alcohol or substance abuse treatment
  • Serve 24 to 36 month license suspension
  • You will be required to install an ignition interlock device for the length determined by court

*If aggravating circumstances were present - minimum 60 days imprisonment.

Aggravating Circumstances

Results in a higher minimum jail time:

  • Over 30 mph over speed limit
  • Wrong way on limited access highway
  • Causes accident resulting in death or serious physical injury
  • Alcohol level of 0.15 or more within two hours after operating
  • Refusal to submit to testing for 2nd or subsequent offenses
  • Transporting passengers under 12 years of age

Ignition Interlock Requirements

You must submit these items to the transportation cabinet prior to installing your ignition interlock:

  • Application and processing fee
  • Court order
  • Proof of insurance and valid vehicle registration

Once you are approved to install your ignition interlock device, you will receive an approval letter from the Division of Driver License. At this point, you can call in and schedule your installation at a service center closest to you. You are required to have your ignition interlock device installed within 30 days of your court order.

NOTE: If you are installing an ignition interlock device in a vehicle you do not own, you will need to present a written notarized statement from the vehicle’s owner at the time of installation.
