If you are arrested for a first DUI offense in Delaware, your license will be suspended upon arrest and you will be given a temporary 15 day driver’s license. You must request an administrative hearing at the DMV within 15 days of your arrest.
If you fail to request an administrative hearing or you receive an unfavorable ruling at the hearing, your license will be revoked for 3 months. All DUI offenders are required to install an ignition interlock device (IID) on their vehicle in order to regain any driving privileges following the minimum 30 day license suspension.
Offenders will also be required to pay any fines, pay any license reinstatement fees, complete any alcohol treatment or educational programs, and have refrained from driving during the mandatory revocation period in order to be approved for an IID license. The IID will need to remain on the vehicle for a minimum of 5 months up to a time indicated by the courts following a satisfactory completion of the state mandated programs.

If you are arrested for a third DUI offense in Delaware, your license will be suspended upon arrest and you will be given a temporary 15 day driver’s license. You must request an administrative hearing at the DMV within 15 days of your arrest.
If you fail to request an administrative hearing or you receive an unfavorable ruling at the hearing, your license will be revoked for 18 months. All DUI offenders are required to install an ignition interlock device (IID) on their vehicle in order to regain any driving privileges during the minimum 6 month license suspension.
Offenders will also be required to pay any fines, pay any license reinstatement fees, and not driven during the mandatory revocation period in order to be approved for an IID license. The IID will need to remain on the vehicle for a minimum of 18 months up to a time indicated by the courts following a satisfactory completion of the state mandated programs.
Refusal to submit to a sample for testing will cause you to lose your license for a period of 12 months up to a period of 24 months. Since February of 2015, Delaware has been an all-offender state and requires all first-time offenders to use an ignition interlock following a drunk driving conviction. The IID will remain on the vehicle for a period of time based on the number of prior DUI offenses.
