      Idaho has a variety of penalties for driving under the influence (DUI), including both financial and administrative penalties. This guide will discuss the interlock program and policies in Idaho.

      The ID Ignition Interlock Program

      In Idaho, the legal blood alcohol content limit is .08 percent, and drivers who test at or above that level risk a DUI conviction. With a DUI conviction, there are administrative penalties that include license suspension. Many offenders may have their license suspended, but some could be eligible for a diversion program. Participants in the diversion program are required to install an ignition interlock device (IID) in order to regain their driving privileges.

      What Happens if I Get a DUI in Idaho?

      There are a variety of penalties for DUI in Idaho. The penalties increase if there are prior offenses on record or depending on the specifics of the incident.

      First DUI Offense

      • Six months jail time
      • License suspension of 90 to 180 days
      • Up to $1,000 in fines
      • Some qualified offenders may be able to enter a diversion program if they install an IID

      Second DUI Offense

      • Jail time of 10 days to one year
      • Fines up to $2,000
      • License suspension of one year
      • Required to install an IID to regain driving privileges

      Third DUI Offense

      • If the third offense is within five years, the offense may be considered a felony
      • Jail term of 30 days to five years
      • Fines up to $5,000
      • Driver’s license suspended for one year, possibly more
      • Required to install an interlock device

      First DUI Offense (With High BAC)

      • Mandatory jail time of 10 days, up to one year
      • Fines of up to $2,000
      • Mandatory license suspension for one year, with no driving privileges of any kind

      Second DUI Offense (Within 5 Years)

      • 30 mandatory days in jail
      • State penitentiary sentence up to 10 years
      • Fines of up to $5,000
      • Driver’s license suspended for as long as five years, one year without any driving privileges

      What Happens if I Fail to Complete or Refuse to Submit to a DUI Test in Idaho?

      Offenders who refuse to take the test will still be penalized. They risk having their license suspended for one year.

      How Do I Regain Driving Privileges in Idaho?

      Qualified offenders may be able to regain driving privileges during their suspension period by obtaining a restricted driving permit. They must also meet additional criteria, including:

      • Pay all fines and finish any court-ordered treatment or community service
      • Submit an application form for a restricted driving permit
      • Obtain SR-22 insurance and show proof
      • Get a signed and dated Driver’s Agreement
      • In some cases, the driver may need to provide work or school verification of their schedule
      • Must install an interlock device from an approved provider.

      There may be additional criteria depending on the circumstances of the incident. Some offenders may be required to complete additional tasks or wait out a portion of their suspension period.

      Idaho FAQs

      An ignition interlock device is a breathalyzer device that acts as a gatekeeper, ensuring only sober drivers can start the engine.

      Some drivers are required to install an ignition interlock by the court or the DMV following a conviction for drunk driving. The interlock device must be from a state-approved provider, like Intoxalock.

      Offenders are required to cover the cost of their interlock device. The devices can vary in price depending on your vehicle’s make and model, and your chosen interlock provider. Intoxalock customers will pay a $91.99 to $100 deposit, and a $29.99 setup fee. Customers will also pay $41.99 to $99.99 monthly to lease the device.

      If your device was mandated by the court, you will need to send the court order to idaho-compliance@intoxalock.com prior to installation. You will need to provide your monitoring authority’s name and contact information. When you are ready to install, you can make an appointment with the service center of your choosing.

      You should have your Idaho driver’s license, as well as the name of the registered vehicle owner.

      Intoxalock has more than 50 locations throughout Idaho, making it easy for you to find one close to you. You will return regularly for device calibration, so be sure to choose a convenient location.

      You can have your device removed at the service center where it was installed. The court should send a removal order, but it is not required for device removal.

      You do not need to bring any paperwork, but customers who remove the device before their requirement is done should be aware that the monitoring authority will be notified.

      Financial penalties, community service, and possible education classes are potential DUI requirements.

      Customers who are deemed indigent by the court may be able to receive financial assistance for the cost of their interlock device.
