When do I need to install my ignition interlock device?

Following a drunk driving arrest, you’re faced with many obligations to keep your life moving. Your license has likely been revoked, and you’ll be busy with court obligations, attorney meetings, DMV hearings, paperwork submissions deadlines and more. For many of those arrested with a DUI / OWI / DWI, license revocation is a serious setback. If you drive to work and don’t have other reliable transportation, not having a license could mean losing income and potentially, your job. With your time already stretched thin, one of your top priorities will be ensuring you’re able to legally drive again as soon as possible. The best way to get back on the road without unnecessary delays is to install an ignition interlock device (IID), or car breathalyzer, as soon as you know you’ll need one.

Typically, interlock devices are court-ordered and installation and reporting are monitored by the court or a state agency like the Department of Motor Vehicles or the Department of Transportation.

Many states have ignition interlock device requirements for at least some drivers convicted of drunk driving offenses. Some states require it for first-time offenders, others for aggravated offenders or repeat offenders. Typically, states vary in the type of offense for which they require an IID, when drivers are allowed to regain their driving privileges, and what the restrictions on their license are while they have the interlock device installed. Here’s what to do if you’ve been arrested for a drunk driving offense:

  • Start planning to install an ignition interlock device (car breathalyzer) right away: Making plans to install your IID as early as possible, once it’s officially required by the state will ensure you can get back on the road quickly and without the stress of worrying about being caught driving without one.
  • Contact an attorney if you want representation: an attorney can help guide you through the process and represent your interests in court. It’s not necessary to have one, but if you think you do, researching ahead of time will be helpful.
  • Determine transportation needs and which vehicle to install your IID: If you own multiple cars, you may need to install a device in all of them, or limit yourself to driving one of them, depending on rules in your state. If you share a car, you will still need to install the IID and the other driver will need to use the device as well.

How to Know if Your State Requires Ignition Interlock Devices
