2019 Brings New California Law on Drunk Driving

On January 1st, California’s new ignition interlock device law took effect state-wide. The new law (SB-1046) allows all drunk driving offenders, even first-time offenders, to install an ignition interlock device following arrest to regain unlimited driving privileges.

Now, all California drivers receiving a first offense DUI which involves no injuries can select either a six month ignition interlock program with full driving privileges or a one year license restriction that only allows them to drive to and from work and a state-approved alcohol rehabilitation program.

California pilot program – a brief history

In 2010, California passed a law (AB-91) implementing a pilot program in four counties. This program required individuals convicted of first and repeat DUI offenses in Alameda, Los Angeles, Sacramento and Tulare County to install an ignition interlock device on all vehicles they owned or operated.

This pilot program was put into place with the goal of cutting down on the number of drunk driving accidents and helping to eliminate fatalities caused by repeat drunk drivers.

In 2018, Intoxalock ignition interlock devices prevented nearly 24,000 vehicle startup attempts from drivers with a BrAC showing a presence of alcohol. Almost a quarter of those were from people who registered a BrAC above the legal limit of 0.08 when attempting to start their vehicles.

Data collected shows that approximately half of DUI offenders in California previously chose to drive illegally following arrest, instead of abiding by the driving restrictions put in place by the previous law, leading to an increase in repeat arrests, accidents, and additional punishments as a result of getting caught.

The new law allows more people to navigate through the process legally, as quickly as possible, while regaining their driving freedom needed to maintain their day-to-day lives.
