Texas refers to drunk driving or alcohol-based driving offenses as DWI, and penalties include fines, jail time, and license suspension. The legal limit for drivers is below .08% BAC, but those with lower BAC may still find themselves facing consequences depending on the circumstances of the incident. Some offenders are able to regain driving privileges by installing an ignition interlock device from an approved provider. This guide will explain the interlock policy in Texas.
Offenders who commit DWI with a child passenger in the car risk an additional charge of child endangerment. This comes with penalties including a $10,000 fine, 2 to 10 years in prison, and a loss of driving privileges for up to two years.
Offenders who refuse to take a DWI test when stopped on suspicion of DWI will still face penalties. They include immediate license suspension.
Some drivers are eligible to regain driving privileges if they meet a variety of criteria. These criteria include:
Prior to September 1, 2023, judges had discretion over whether or not an IID was required. As of September 1, 2023, judges still have limited discretion when it comes to IID installation. However, in DWI cases, installing an IID is often required in order to obtain an Occupational Driver’s License.
Intoxalock is an approved ignition interlock device provider in the state of Texas. This means that the state has reviewed and approved the device and determined it to be reliable and meet state criteria. Testing data is shared with the appropriate state monitoring authority.
Ignition interlock devices are also known as car breathalyzers or IIDs. They are installed into a vehicle’s ignition system and require testing before a driver can start their car.
This will be clarified in court, but typically interlock devices are required throughout the entire license suspension period, and occasionally longer. If you are unsure, contact your attorney, the court, or your state department of motor vehicles for clarification.
Offenders are required to cover the costs of their device, which includes installation and leasing costs. The devices cost roughly $100 to install, and $2.50 and $3.50 per day to lease. Intoxalock allows flexible payment options and online payments for convenience. Some offenders who are unable to afford the cost may be eligible for financial aid. Check with the court to see if you qualify.
Intoxalock has more service locations than any other provider. With more than 5,200 locations nationwide, it’s easy to find one that is near you. Keep in mind that you will need to return multiple times throughout the interlock term for device calibration, so find a location that is close to home or work.
