If you are convicted with a first DUI offense in South Carolina, your license will be suspended for a period of six months upon your conviction. First time offenders may spend anywhere from 48 hours to 90 days in jail depending on the blood alcohol concentration (BAC) level measured at the time of the arrest. First time offenders may request community service time in lieu of jail time. The amount of community service hours would be equal to the hours of jail time.
First time DUI offenders with a BAC of .08 to .14 your license is suspended for 6 months. You may request and be granted a temporary provisional license upon mandatory completion of an alcohol treatment program. You may also choose to install an ignition interlock instead of the license suspension. Once enrolled, however, you cannot subsequently choose to serve the suspension.
First time DUI offenders with a BAC level of .15 or higher are required to install an ignition interlock device (IID) on their vehicle and obtain an ignition interlock restricted license. The device is required for six months in order to regain any driving privileges.
Offenders will also be required to pay up to $1000 in fines, in addition to any other fees imposed by the state.
If you are arrested for a second DUI offense in South Carolina, you can spend anywhere from 5 days to 3 years in jail. You will be required to complete an alcohol treatment program.
All second offense DUI offenders are required to install an ignition interlock device (IID) on their vehicle and obtain an ignition interlock restricted license in order to regain any driving privileges following the completion of the mentioned alcohol treatment program. The IID will remain on the offender’s vehicle(s) for a period of two years.
Offenders will also be required to pay $2,100 - $6,500 in fines, in addition to any other fees imposed by the state.
If you are arrested for a third DUI offense in South Carolina, you can spend anywhere from 60 days to 5 years in jail. You will be required to complete an alcohol treatment program.
All third offense DUI offenders are required to install an ignition interlock device (IID) on their vehicle and obtain an ignition interlock restricted license in order to regain any driving privileges following the completion of the mentioned alcohol treatment program. The IID will remain on the offender’s vehicle(s) for a period of three years. If an offender has had three DUI convictions within a five year period, the IID will be required for a period of four years.
Offenders will also be required to pay $3,800 - $10,000 in fines, in addition to any other fees imposed by the state.
