First Offense DWI in New York
New York drivers who are convicted of a DWI for the first time are subject to potential jail time, fines, and license revocation for a minimum of six months.
If the conviction results from a DWI with a BAC of equal to or more than .08, the driver can only operate vehicles with an ignition interlock device from an approved provider like (Intoxalock ).
If injury or death was caused during the accident, fines and jail time will increase. Offenders who have a minor in the car will also be subject to additional penalties.
Second Offense DWI in New York
A second conviction within 10 years in New York will result in increased penalties. Convicted drivers can receive up to four years in jail, $1,000 to $5,000 in fines, and at least one-year license revocation. A convicted driver must only operate vehicles equipped with an IID from an approved provider like (Intoxalock ).
Third Offense DWI in New York
A third conviction will be taken very seriously, and anyone convicted of driving under the influence of alcohol for the third time will have their license revoked for at least 1 year and will be required to only operate vehicles with an IID from an approved provider like (Intoxalock ). They also risk up to seven years in jail and $2,000 to $10,000 in fines.
To Get a Conditional License in New York for 1st time offenders who have not had a DWI or DWAI conviction within the last 5 years may need to:
- Complete a course via the state’s Impaired Driver Program
- Complete all program and treatment requirements
- Pay any required fees and fines
- Install an ignition interlock device on any vehicle you plan on driving from an approved provider like (Intoxalock )
- In some instances, you may be referred for assessment by a New York State court or probation office prior to enrolling in the IDP
