First Offense DUI in Kentucky
Kentucky drivers who are convicted of DUI for the first time may have their license suspended for 6 months but could have that suspension lessened with the installation of an ignition interlock device. Drivers are also subject to potential jail time, fines, and may be required to attend alcohol or substance treatment classes.
As of July 1, 2020, the Kentucky Transportation Cabinet hands down a static suspension period based on the offense. After serving a specified portion of the suspension period, offenders can apply for an ignition interlock license. If approved, they will be able to drive if they install an IID from an approved provider like (Intoxalock ).
Second Offense DUI in Kentucky
Second-time DUI offenders in Kentucky risk increased penalties. They can receive 7 days to 6 months in jail, $350 to $500 in fines, and a requirement to attend an alcohol or substance abuse treatment program. To have their license suspension reduced, they must install an IID from an approved provider like (Intoxalock ) on all vehicles they operate.
Third Offense DUI in Kentucky
Third offenses are taken very seriously, and anyone convicted of driving under the influence of alcohol for the third time will have their license suspended for 36 months. They also risk 30 days to 12 months in jail, $500-$1,000 in fines, and must complete an alcohol or substance abuse treatment program.
Installation of an IID from an approved provider like (Intoxalock ) could reduce the license suspension.
To obtain an Ignition Interlock License, drivers may need to:
- Show proof of a valid Kentucky vehicle registration (or out-of-state registration if the offender is out of state)
- If the driver is not listed on the registration, they must provide a notarized letter from the owner giving permission to install the device in their vehicle
- Pay a $40 Reinstatement fee
- If approved, drivers will receive a Letter of Approval, which must be taken to the state-approved interlock provider like (Intoxalock ) when it is time for installation
- The service center will give the driver a Certificate of Installation once the IID is installed, which the driver will take to the license-issuing location as proof of installation
