First Offense DUI in Florida
In Florida, the penalties for DUI increase depending on various factors of the offense. If a driver is caught with a blood alcohol content of more than .08, they risk a DUI conviction. They may have to pay a fine of up to $1,000. Their driver’s license may be revoked for up to a year, and they may have to install an ignition interlock device from an approved provider like (Intoxalock ).
This fine may increase up to $2,000 if there was a minor present at the time or if the breath alcohol level was 0.15 or higher. In addition to the fines, drivers risk up to six months in jail or nine months if a minor was in the car or their BAC is equal to or more than .15. Their driver’s license may be revoked for up to a year, and, if their BAC was at or above 0.15 or a minor was present, they will have to install an ignition interlock device from an approved provider like (Intoxalock ) to regain driving privileges. If anyone is injured, the revocation increases to a minimum of three years.
Refusal of a Breath Test: This can carry many similar penalties to a DUI conviction.
Second Offense DUI in Florida
Repeat offenders will automatically pay a fine of at least $1,000, and possibly up to $2,000, for a second DUI offense. If a child was present or if the breath alcohol level was 0.15 or higher, it could increase up to $4,000. They could also spend up to nine months in jail, or up to 12 months if a child is present. If they are convicted a second time within five years of their first conviction, they will have to serve a mandatory 10-day jail sentence. If the offense is within five years, drivers risk their license being revoked for five years.

If their third conviction is within 10 years of a prior, they also risk mandatory jail time of at least 30 days. They may also receive additional jail time up to 12 months. Their license may be revoked for up to 10 years if it’s less than 10 years since the previous offense, but they would be eligible for a hardship license after 2 years.
