Regain driving privileges in Kentucky
As of today, all alcohol-related DUI (Driving Under the Influence) offenders will be required to install an ignition interlock device (IID) if they wish to drive during their license suspension period.
An IID is also commonly known as a car or vehicle breathalyzer. For vehicles with an IID installed, the device measures the breath alcohol concentration (BrAC) of the driver prior to starting the vehicle. If the driver has a BrAC higher than a pre-set level determined by the state, the vehicle will not be able to start.
Is there a sit out option in Kentucky?
Under the new SB 85 provision, those with a DUI conviction may choose not to install an IID during their suspension period, however driver will have a full license suspension for duration of their sentence. A full license suspension means that they are not able to drive for any reason.
When are IIDs mandatory in Kentucky?
For any first-time offender who has a susupended license but would like to regain driving abilities during their suspension period, an IID installation is required. For those who have a repeat DUI conviction(s) or DUI testing refusals at any within the prior 10 years, Kentucky may issue court-orders for the installation of an ignition interlock device. Drivers who caused a crash resulting a death or serious injury to another person(s) will need to install an IID. For these all of these drivers, the installation of the IID is mandatory in order to resume driving.
Court approval no longer needed to install an IID
SB 85 allows for offenders to automatically be eligible to install an IID without having to request approval to get the device installed. The introduction of IIDs and the immediate eligibility to get installed allows individuals with license suspensions to resume driving activities such as travel to work, school, appointments, errands, and other important tasks for drivers and their families.
This legislation lets those with a DUI conviction navigate more quickly through the suspension and to decrease the chances of a follow-up offense. In addition, documented sobriety through the use of the ignition interlock device could assist in future court appearances related to their DUI charge.
